Community Property in Divorce

"Community property" generally includes assets acquired during the marriage and excludes assets owned by either partner before the marriage. However, there are some situations in which income or property could be considered separate property even though it was acquired during the marriage. And there are situations in which property, such as a business, could be considered "community property" because of the way it was handled during the marriage.
